Eligibility:

Xyfon.com reserves the right to disapprove of a referral account if it determines that any of the following conditions apply; i) the referred client is a pre existing client ii) the account is managed by a third party iii) the referred client is an immediate family member iv) the account is referred by an introducing broker.

1. Persons who may be referred: You may only refer this "Promotion" to individuals with whom you have a personal or business relationship and whom you believe would like to receive the "Promotion". Without limiting the generality of the foregoing, you may not submit for referral i) group email addresses ii) email mailing lists, or iii) yourself.
   
   

2. Promotion sent to friends: Xyfon.com will send on your behalf an email to each "Friend" that you refer. Each email that is sent under the Referral Program will contain the "Promotion".
   

3. Your consent to use your data in emails: You grant Xyfon.com your consent to use your name and email address for the purposes of sending an email to your "Friends". You agree not to use any false email addresses, or names for this Refer a Friend Program.
   
   

4. Limitation of liability for sponsor: To the fullest extend permitted by law, neither the "Sponsor" nor any of its affiliates, directors, employees or other representatives will be liable for damages arising out of or in connection with this program. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect, or consequential damages; loss of data, income, or profit; loss of or damage to property; and claims of third parties.
   
   

5. Currency: All amounts stated in these Program Rules are in Canadian dollars.
   
   

6. Entire agreement: These program rules represent the entire agreement between you and "Xyfon" with respect to the Referral Program.
   
   

7. Variation of program rules: These program rules may be amended or modified by "Xyfon" at its sole discretion at any time. Any such amendments will be posted to this page and it is your responsibility to review this page from time to time for such amendments.
   
   

8. Severance: In any provision of these program rules is held to be invalid; such invalidity will not affect the remaining provisions.
   
   

9. Governing Law: These program rules will be interpreted, construed, and enforced in all respects in accordance with the laws of the province of British Columbia, without giving effect to any principles of conflicts of laws. You hereby irrevocably consent and submit to the nonexclusive personal jurisdiction of the state and federal courts within B.C, for the purpose of litigating any such action.
   
   

10. Additional Terms and Conditions: Xyfon reserves the right to modify, suspend or terminate the Program in its entirety at any time and for any reason in its sole discretion. Void where prohibited by law. This Program and these Terms and Conditions are subject to all applicable federal, state and provincial laws and regulations. Any credit will be net of taxes and you must pay any applicable taxes. If in Xyfon's opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Program or the credits, or if a computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Program, Xyfon.com reserves the right at its sole discretion to disqualify any individual involved in any such harmful or illegal activities, and to modify or suspend the Program, or to terminate the Program. Any attempt by an entrant or any other individual to deliberately damage any web site or undermine the legitimate operation of the Program is a violation of criminal and civil laws and should such an attempt be made, the Xyfon.com reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Any attempts by an individual to access any web site associated with this Program via a bot script or other brute force attack or any other unauthorized means will result in the IP address becoming ineligible, in addition to any other remedies available at law or in equity. Use of automated, programmed, falsified or the like entry devices or programs is prohibited and all such entries are void.
